What You Need to Know About the Groundbreaking EU AI Act and the Difficult Task Ahead in it’s Implementation

The European Union has made history by approving the AI Act, the first comprehensive legislation aimed at regulating artificial intelligence (AI) systems across the 27 member states. After intense negotiations, the European Commission, Council, and Parliament reached an agreement on this landmark regulation on December 8, 2023, but it still needed a vote. In March 2024, the European Parliament passed the Artificial Intelligence Act (AI Act) , marking it the world's first major act to regulate AI.

The EU AI Act establishes a harmonized, risk-based framework to govern the development, deployment, and use of AI within the EU. Its goal is to ensure AI systems are safe, transparent, ethical, and respect fundamental rights while fostering innovation in this transformative technology.

Key Aspects of the EU AI Act:

1. Definition of AI Systems: The Act adopts the OECD's definition of an AI system as "a machine-based system that infers how to generate outputs that can influence physical or virtual environments."

2. Risk Classification: AI systems are classified into four risk levels: unacceptable risk (prohibited), high-risk, limited risk, and minimal risk.

3. Prohibited Practices: Certain AI practices are banned outright, including those that manipulate human behavior, use real-time biometric identification in public spaces, deploy social scoring systems, and make inferences about sensitive personal characteristics.

4. High-Risk AI Systems: Systems deemed high-risk, such as those used in critical infrastructure, employment, education, and law enforcement, face stringent requirements. These include rigorous testing, human oversight, transparency, risk management, and conformity assessments before market entry.

5. General Purpose AI and Foundation Models: A special regime is introduced for general-purpose AI systems and large foundation models capable of performing various tasks. These must undergo comprehensive evaluations, adversarial testing, cybersecurity measures, and disclose energy consumption and training data summaries.

6. Transparency and Documentation: All AI systems are subject to basic transparency obligations, while high-risk systems require extensive documentation, including data usage, model architecture, and fundamental rights impact assessments.

Significant penalties, up to €35 million or 7% of global turnover, are imposed for non-compliance, with some exceptions for SMEs and startups.

8. Transition Periods: The Act introduces staggered transition periods, with bans taking effect in 6 months, rules for foundation models in 1 year, and high-risk AI system requirements in 2 years after the Act's publication in early 2024.

The EU AI Act is a pioneering effort to strike a balance between promoting innovation and ensuring the responsible development and use of AI systems. The Act sets a global benchmark for AI governance and is expected to significantly influence AI regulations in other regions. However, challenges lie ahead in its implementation, due to the ever evolving AI landscape. Here are some key challenges why regulating AI is going to be difficult:


1. Defining AI is Complex: There is no universally agreed-upon definition of what constitutes an AI system. AI can encompass a wide range of technologies, from narrow applications like speech recognition to more general systems that can learn and make decisions across multiple domains. Clearly delineating the scope of AI systems to be regulated is an inherent challenge.

2. The Pace of Innovation: AI is an incredibly fast-moving field, with new breakthroughs and applications emerging constantly. Regulations often struggle to keep up with the speed of technological change, risking becoming outdated or stifling innovation if they are too prescriptive.

3. The "Black Box" Problem: Many advanced AI systems, particularly deep learning models, are opaque in how they arrive at outputs from data inputs. This lack of transparency and explainability makes it difficult to assess compliance with principles like fairness, accountability and safety.

4. Unintended Consequences: AI systems can behave in unexpected ways, with small changes in data or models leading to vastly different and potentially harmful outcomes. Anticipating and mitigating all possible unintended consequences is an immense regulatory challenge.

5. Tension with Innovation: There are concerns that overly burdensome AI regulations could hamper innovation and competitiveness, especially for startups and smaller players. Striking the right balance between protecting rights/safety and enabling beneficial AI development is tricky.

6. Global Governance Challenges: AI is a global phenomenon, but there is a lack of international coordination and alignment on governing principles and regulations. Different regional or national approaches could create a patchwork of rules that impedes cross-border AI applications.

7. Societal and Ethical Factors: Questions of AI ethics, accountability, privacy, bias and social impacts elevate AI governance beyond just technical matters. Reconciling different social and cultural values around AI poses difficulties.


As the EU AI Act and other emerging regulations show, policymakers are actively grappling with these challenges. Multi-stakeholder collaboration involving governments, industry, civil society and academics will likely be key to developing adaptive and effective governance frameworks for AI in the years ahead.
